Service details

Our service

We handle EU trademark registration: we first carry out a trademark search, checking the same or similar trademarks already on the register in the European Union, then confirm with your company the classes of goods or services to select, draw up and file the application documents, and follow up every notice issued by the registry until registration. The trademark search is free, as are the notarisation and legalisation fees.

For trademark registration in other places, see Trademark Registration.

What can be registered as a trademark

A trademark may be any sign that is capable of being perceived visually and represented graphically. It may consist of words, a person, a name, letters, numerals, figurative elements or a combination of colours, and includes any combination of those signs; it may also consist of a three-dimensional shape, provided the shape can be recorded and published, for example presented as a drawing or as a description in words. To improve the chance of registration in the European Union, we recommend a device created by the applicant, carrying no particular meaning as words, and both distinctive and novel.

The registration procedure

  • Confirm the trademark to be applied for: words, a figure, a combination or a three-dimensional shape.
  • Select the trademark classes: follow the classification of goods and services and match them to the classification list.
  • Carry out a similarity search and a risk assessment: avoid marks too close to existing registrations, or falling within another party’s rights.

See how goods and services are classified; if your company cannot determine the classes to select, send us the list of goods or services to check.

Documents required

  • The applicant’s name, address and other basic particulars
  • The trademark itself, as a text or image file, presented clearly where required
  • The list of goods or services, matched to the classes selected

Processing time and term of validity

Once the application is filed, registration takes 15-18 months and the registration is valid for 10 years. The processing time is determined by the progress of examination at the registry in the European Union.

Scope of protection

The EU trademark member states do not include European countries such as Belarus, Iceland, Russia, Serbia, Switzerland, Turkey and Ukraine. If the mark needs protection across a wider European market, we recommend registering the EU trademark and, at the same time, supplementing it with individual registrations in the important European countries.

A trademark right is bounded by the place of registration

A trademark registered in Hong Kong is protected only in Hong Kong. If your company sells or sets up a presence in an EU member state and has not registered the trademark in the European Union, and another party applies first for the same or a similar mark and obtains registration, your company has no registered trademark right to assert in the European Union and will find it difficult to stop that party from using it; the brand spending already committed loses its basis. Registration in the European Union follows the order in which applications are filed, and the processing time is counted in months, so the date of filing often decides who owns the mark.

Full service details and requirements

A trademark registration takes effect only where it is registered. A trademark registered in Hong Kong does not extend to the European Union; if your company sells or sets up a presence in an EU member state without registering the trademark locally, and another party applies first for the same or a similar mark and obtains registration, your company has no registered trademark right to assert there.

We handle EU trademark registration: one trademark, one class HK$11,500, each additional class $2,000; registration takes 15-18 months and is valid for 10 years. The trademark search and the notarisation and legalisation fees are all free of charge. The EU trademark member states do not include European countries such as Belarus, Iceland, Russia, Serbia, Switzerland, Turkey and Ukraine.

Common questions

Call us 2102 7172
Is a trademark registered in Hong Kong also protected in the European Union?
It is not. A trademark right is bounded by the place of registration, and a trademark registered in Hong Kong is protected only in Hong Kong. If your company sells or sets up a presence in an EU member state, it must file a separate application there; without local registration, the Hong Kong registration cannot be relied on to assert trademark rights locally, and it is difficult to stop others from using the same or a similar mark.
How long does EU trademark registration take, and how long is it valid?
Once the application is filed, registration takes 15-18 months and the registration is valid for 10 years. The processing time is determined by the progress of examination at the registry in the European Union, and we notify your company at each stage.
How is the fee for EU trademark registration calculated?
The fee is calculated by the number of trademarks and the number of classes. One trademark, one class is $11,500, and each additional class is $2,000. The trademark search is free, as are the notarisation and legalisation fees.
What documents are required for the application?
The applicant's name, address and other basic particulars; the trademark itself, that is the text or image file, presented clearly where required; and the list of goods or services, matched to the classes selected. Once your company has provided the above, we draw up the application documents.
How should the trademark classes be chosen?
Classes follow the classification of goods and services, and every item must be checked against the classification list. Classes chosen too narrowly leave the goods or services actually traded outside the scope of protection; chosen too widely, they increase the fee and the chance of opposition. See how goods and services are classified; if your company cannot determine the classes to select, send us the list of goods or services to check.
Is a similarity search required before filing?
It is. The purpose of a similarity search is to check the same or similar trademarks already on the register locally, to assess the risk of opposition and to avoid falling within another party's rights. We carry out a trademark search for your company before filing, at no additional charge.
Does an EU trademark cover the whole of Europe?
Not the whole of Europe.
