Registration by market

Our service

We first carry out a trademark search for your company, checking the same or similar trademarks already on the register locally, then settle the classes of goods or services and the places of application, file the application on your company’s behalf and follow up the notices issued by the registry until registration. If the trademark owner is a newly formed company, this can be arranged together with Hong Kong company registration; the owner’s name and address are as stated in the registration documents.

What can be registered as a trademark

A trademark is used to promote and identify the goods or services of its owner, and protects the company’s reputation and profit. A trademark may be any sign that is capable of being perceived visually and represented graphically. It may consist of words, a person, a name, letters, numerals, figurative elements or a combination of colours, and includes any combination of those signs; it may also consist of a three-dimensional shape, provided the shape can be recorded and published, for example presented as a drawing or as a description in words.

To improve the chance of registration, we recommend a device created by the applicant, carrying no particular meaning as words, and both distinctive and novel.

A trademark right is bounded by the place of registration

A trademark registration takes effect only where it is registered. A trademark registered in Hong Kong is protected only in Hong Kong; every market the goods or services reach requires a separate application there. Where there is no local registration and another party applies first for the same or a similar mark, your company has no registered trademark right to assert in that place, and the brand spending already committed loses its basis. The processing time in each place is counted in months, so the date of filing often decides who owns the mark.

Full service details and requirements

A trademark right is bounded by the place of registration. A trademark registered in Hong Kong is protected only in Hong Kong; every market your company's goods or services reach requires a separate application there, failing which, once another party applies first for the same or a similar mark, your company has no registered trademark right in that place on which to rely.

We handle trademark registration in Hong Kong, China, Macau, Taiwan, the United Kingdom, the United States, Canada, France, Germany, Japan, South Korea and the European Union: we first carry out a trademark search and check the same or similar trademarks already on the register, then settle the classes and the places of application, file the application on your company's behalf and follow up the notices issued by the registry. The fees, processing time and term of validity for each place are set out on the market pages below.

Is a trademark registered in Hong Kong also protected elsewhere?
It is not. A trademark right is bounded by the place of registration, and a trademark registered in Hong Kong is protected only in Hong Kong. Wherever your company's goods or services are sold, manufactured or promoted, an application must be filed in each of those markets; without local registration, the Hong Kong registration cannot be relied on to assert trademark rights there.
What may a trademark consist of?
A trademark may be any sign that is capable of being perceived visually and represented graphically. It may consist of words, a person, a name, letters, numerals, figurative elements or a combination of colours, and includes any combination of those signs. A trademark may also consist of a three-dimensional shape, provided the shape can be recorded and published, for example presented as a drawing or as a description in words.
What kind of trademark is more likely to be registered?
A device created by the applicant, carrying no particular meaning as words and both distinctive and novel, has a higher chance of registration. A device identical or similar to an existing trademark, and words that merely describe the goods or services themselves, carry a higher risk of opposition.
Which market should be registered first?
That is decided by the markets in which your company actually operates. The places where the goods or services are already sold, manufactured or promoted, and the places your company plans to enter shortly, should be dealt with first, because registration follows the order in which applications are filed and the processing time in each place is counted in months.
Is a trademark search required before filing?
It is. The purpose of the search is to check the same or similar trademarks already on the register locally, to judge the risk of opposition and to settle the classes of goods or services to select. We carry out a trademark search for your company before filing.
Which markets do you handle trademark registration in?
Hong Kong, China, Macau, Taiwan, the United Kingdom, the United States, Canada, France, Germany, Japan, South Korea and the European Union. The registration fee, the fee for each additional class, the processing time and the term of validity for each place are set out on that market's page.
