Service details

Our service

We handle France trademark registration: we first carry out a trademark search, checking the same or similar trademarks already on the register in France, then confirm with your company the classes of goods or services to select, draw up and file the application documents, and follow up every notice issued by the registry until registration. The trademark search is free, as are the notarisation and legalisation fees. After registration, we check the registration particulars and handle the renewal before the term of validity expires.

For trademark registration in other places, see Trademark Registration.

What can be registered as a trademark

A trademark may be any sign that is capable of being perceived visually and represented graphically. It may consist of words, a person, a name, letters, numerals, figurative elements or a combination of colours, and includes any combination of those signs; it may also consist of a three-dimensional shape, provided the shape can be recorded and published, for example presented as a drawing or as a description in words. To improve the chance of registration in France, we recommend a device created by the applicant, carrying no particular meaning as words, and both distinctive and novel.

The registration procedure

  • Confirm the trademark to be applied for: words, a figure, a combination or a three-dimensional shape.
  • Select the trademark classes: follow the classification of goods and services and match them to the classification list.
  • Carry out a similarity search and a risk assessment: avoid marks too close to existing registrations, or falling within another party’s rights.

See how goods and services are classified; if your company cannot determine the classes to select, send us the list of goods or services to check.

Documents required

  • The applicant’s name, address and other basic particulars
  • The trademark itself, as a text or image file, presented clearly where required
  • The list of goods or services, matched to the classes selected

Processing time and term of validity

Once the application is filed, registration takes 6-10 months and the registration is valid for 10 years. The processing time is determined by the progress of examination at the registry in France.

A trademark right is bounded by the place of registration

A trademark registered in Hong Kong is protected only in Hong Kong. If your company sells or exhibits at trade fairs in France and has not registered the trademark in France, and another party applies first for the same or a similar mark and obtains registration, your company has no registered trademark right to assert in France and will find it difficult to stop that party from using it, and the investment already made in the brand is put at risk. Registration in France follows the order in which applications are filed, and the processing time is counted in months, so the date of filing often decides who owns the mark.

Full service details and requirements

A trademark registration takes effect only where it is registered. A trademark registered in Hong Kong does not extend to France; if your company sells or exhibits at trade fairs in France without registering the trademark locally, and another party applies first for the same or a similar mark and obtains registration, your company has no registered trademark right to assert there.

We handle France trademark registration: an application for one trademark is HK$7,800, each additional class $3,800; registration takes 6-10 months and is valid for 10 years. The trademark search and the notarisation and legalisation fees are all free of charge. Renewal is $7,800 for one trademark in up to three classes and $3,800 for each additional class.

Common questions

Is a trademark registered in Hong Kong also protected in France?
It is not. A trademark right is bounded by the place of registration, and a trademark registered in Hong Kong is protected only in Hong Kong. If your company sells or exhibits at trade fairs in France, it must file a separate application there; without local registration, the Hong Kong registration cannot be relied on to assert trademark rights locally, and it is difficult to stop others from using the same or a similar mark.
How long does France trademark registration take, and how long is it valid?
Once the application is filed, registration takes 6-10 months and the registration is valid for 10 years. The processing time is determined by the progress of examination at the registry in France, and we notify your company at each stage.
How is the fee for France trademark registration calculated?
The fee is calculated by the number of trademarks and the number of classes. An application for one trademark is $7,800, and each additional class is $3,800. On renewal, one trademark in up to three classes is $7,800 and each additional class is $3,800. The trademark search is free, as are the notarisation and legalisation fees.
What documents are required for the application?
The applicant's name, address and other basic particulars; the trademark itself, that is the text or image file, presented clearly where required; and the list of goods or services, matched to the classes selected. Once your company has provided the above, we draw up the application documents.
How should the trademark classes be chosen?
Classes follow the classification of goods and services, and every item must be checked against the classification list. Classes chosen too narrowly leave the goods or services actually traded outside the scope of protection; chosen too widely, they increase the fee and the chance of opposition. See how goods and services are classified; if your company cannot determine the classes to select, send us the list of goods or services to check.
Is a similarity search required before filing?
It is. The purpose of a similarity search is to check the same or similar trademarks already on the register locally, to assess the risk of opposition and to avoid falling within another party's rights. We carry out a trademark search for your company before filing, at no additional charge.
